Website Terms of Service

Finlinks Global Solutions LLC
Effective date: October 28, 2026. Updates to existing agreements take effect only through the applicable notice, acceptance or change procedure and do not apply retroactively.

Website information and business software access only. Financial execution is independent. Merchant services require an accepted MSA. Contractual remedies are limited subject to mandatory law.

The FinLinks stablecoin payment integration, merchant portal at portal.finlinks.io and API at api.finlinks.io are operated by Finlinks Global Solutions LLC. The product website is www.finlinksglobal.com. Use of finlinks.io for technical services or business email does not change the operator identified here. Merchant services remain subject to the accepted Master Merchant Services Agreement and applicable third-party terms.

1. Operator and scope

These Terms govern www.finlinksglobal.com and its business software information, operated by Finlinks Global Solutions LLC. Using the website is subject to these Terms to the extent a valid agreement is formed under applicable law. Paid merchant services require separate affirmative acceptance of the Master Merchant Services Agreement (MSA) and an order form.

The accepted MSA controls merchant-service matters over these website Terms. An applicable data processing agreement controls its subject matter. The Privacy Policy explains processing practices and does not waive statutory rights.

2. Business eligibility and authority

The services are intended only for approved business entities through representatives aged 18 or older with authority to act for them. A software workspace or login is not an enterprise financial account. Personal remittances and retail currency-exchange services are not offered. A business merchant's buyers do not thereby become FinLinks financial-account customers.

3. Technology-only services and principal

All transaction principal and settlement funds are processed by independent, appropriately licensed or authorized financial institutions, or, for lawful supported on-chain transfers, by smart contracts controlled by the merchant or an independent third party. A smart contract is not itself a licensed institution and does not replace any required authorization. FinLinks does not control those contracts or their administrative keys and has no authority to sign, redirect, freeze, or retain transaction principal. FinLinks does not provide merchant or end-user financial accounts, pooled balances, stored value, deposit products, yield, or personal remittance or retail currency-exchange services.

Transaction, conversion, clearing, and network fees are charged or deducted by the applicable licensed or authorized provider under its agreement with the merchant. FinLinks does not deduct fees from merchant receipts, intercept incoming principal, or remit a net settlement balance. The merchant pays FinLinks separately invoiced technology software service fees under an agreed order form. Receipt of payment for FinLinks' own software services is not receipt of customer transaction principal. FinLinks never holds, handles, or retains merchant or end-user transaction principal or settlement funds.

Commercial invoices, demonstrations, reconciliation entries, and example code describe software records only. They are not investment advice, binding FX quotes, executed transactions, proof of available funds, or guaranteed arrival commitments.

4. Independent providers and operational risks

Underlying payment execution, foreign exchange, clearing, and movement of funds are carried out by independent third-party institutions under their own authorizations and agreements. FinLinks only forwards merchant-authorized instructions and orchestrates APIs and data records. FinLinks is not a guarantor, co-obligor, settlement counterparty, or agent of those institutions and does not assume joint or several liability for their outages, delays, insolvency, rejected instructions, reversals, or failed settlements. To the extent permitted by law, losses attributable solely to an independent provider are that provider's responsibility under its applicable agreement. This allocation does not excuse FinLinks' own breach or any liability that cannot lawfully be excluded.

Financial-service eligibility, execution, cancellation, reversals, refunds, exchange rates, and safeguards follow the responsible provider's agreement and applicable law. Direct related claims to that provider; FinLinks can offer reasonable technical records and assistance without guaranteeing recovery. API, internet, cloud, telecommunications, and blockchain interruptions may affect status delivery. Confirm authoritative provider status before resubmitting instructions.

5. Acceptable use and software access

Provide accurate business and authorization information; protect credentials; do not misuse private data, breach intellectual property, scrape restricted APIs, bypass controls, transmit malicious code, or facilitate unlawful transactions. FinLinks may restrict website or software access for legal, security, or material contractual reasons. Such restriction does not authorize control over funds held elsewhere.

The website and supplied software are owned by FinLinks or its licensors. Access grants only the limited rights expressly permitted. Third-party materials remain subject to their respective rights and terms.

6. Availability, disclaimers, and liability

Except for express commitments in an accepted service agreement, website content is provided as available, may change, and is not a promise of uninterrupted or error-free service. No statement guarantees third-party solvency, execution, fund recovery, stablecoin value, or settlement time.

To the maximum extent permitted by applicable law, FinLinks is not liable for indirect, consequential, incidental, special, exemplary, or punitive damages, including indirect lost profits, lost business opportunities, business interruption, or consequential currency fluctuation losses, whether foreseeable or not and whether advised of their possibility or not.

To the maximum extent permitted by applicable law, FinLinks' total aggregate liability to a merchant arising out of or relating to the website, software services, MSA, order forms, or these Terms, under any theory of liability, shall not exceed the lesser of (a) the total technology software service fees actually paid by that merchant to FinLinks during the twelve (12) months immediately preceding the first event giving rise to the claim, and (b) US$1,000. Claims arising from the same or related events are aggregated, and this cap is shared across these documents, not multiplied by claim, contract, claimant representative, or legal theory. Transaction principal, settlement amounts, provider charges, FX spreads, network gas, taxes, and amounts not paid to FinLinks as technology software service fees do not count toward the cap. If no qualifying fees were paid during that period, the contractual cap is zero, except to the extent prohibited by law.

Nothing in these documents excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, or any other liability to the extent it cannot lawfully be excluded or limited. Mandatory privacy, data-subject compensation, regulatory, and other statutory rights and obligations remain unaffected. An exclusion or cap applies only to the extent enforceable under the law applicable to the claim.

The same contractual cap applies collectively under these Terms and an applicable MSA; the documents do not create separate cumulative caps. The Privacy Policy does not impose this cap on non-waivable data-subject rights.

7. Disputes, changes, and severability

Wyoming law governs subject to mandatory applicable law. After a good-faith attempt to resolve a dispute, competent state or federal courts in Wyoming have exclusive jurisdiction, subject to mandatory law. No mandatory arbitration is imposed by these Terms.

Material updates will be clearly notified and applied through the legally required acceptance or change procedure, not retroactively. Invalid provisions are limited only as permitted by law without invalidating the remainder. A mere website revision does not amend an already accepted MSA.
